Arbitration at NICArb offers parties the flexibility to tailor the dispute resolution process to their specific needs. While the NICArb Arbitration Rules 2021 provide a solid foundation, parties have the option to customize rules, establish discovery protocols, implement an appeal procedure, and integrate other efficiencies within the Alternative Dispute Resolution (ADR) framework. These options ensure that the arbitration process aligns with international best practices and meets the unique requirements of each dispute.
With the growing trend of virtual dispute resolution, NICArb not only provides enhanced scheduling flexibility but also grants access to a diverse global pool of NICArb arbitrators. This ensures that parties have ample options to select arbitrators who best suit their specific case needs.

Guidelines for Requesting for Appointment of Arbitrator(s)
1. The party requesting an appointment should file a request for appointment with NICArb.
2. The request should include the following information and supporting documents:
• a description of the nature of the dispute;
• the notice of arbitration or equivalent instrument instituting dispute resolution proceedings;
• The dispute resolution clause, the provision designating NICArb as the appointing authority, and any other necessary documents related to the dispute.
• contact details for all parties to the dispute (i.e., postal address, e-mail address, and telephone number);
• signature of the requesting party or its duly authorized representative. A request signed by a representative must enclose proof of the authorization to act, for example, a power of attorney.
3. The Request should be submitted in both hard copies (4 copies) and electronic formats.

• Upon receipt of the Request, an arbitrator(s) shall be appointed in line with Articles 8-10 of the NICArb Arbitration Rules 2021. (A link to the rules should be inserted.)
Guidelines for Initiating Arbitration Proceedings
To initiate arbitration proceedings at NICArb:
• The applicant will be required to fill out a submission form (link to the form- it should be made downloadable)
5. A Request for arbitration containing the information and documents outlined in Article 3 of the NICArb Arbitration Rules 2021. (A link to the Rules should be inserted.) should be dispatched by post or by email to:

6. The Request for Arbitration should be submitted in both hard copy (4 copies) and electronic format.
7. Upon receiving the Request, NICArb will initiate the procedure for appointing an arbitrator as outlined in Articles 7 - 11 of the NICArb Arbitration Rules 2021. (A link to the rules should be inserted.)
8. Kindly note that the NICArb schedule of fees shall be applicable (link attached)
Guidelines for Responding to a Request for Arbitration
9. The Respondent shall send a response within fourteen (14) days of receipt of the Request for Arbitration.
10. The Response to the request for Arbitration shall be filed according to Article 5 of the NICArb Rules 2021. (Insert link to the Rules)
• The Response to the request for Arbitration should be submitted in both physical (hard copies) and electronic formats. The hard copy submission to NICArb should include four (4) copies.
• The Response to the Request should be sent by post or by e-mail to:
